Ellensburg Radio Broadcasting, LLC dba KXLE AM/FM
By entering any contest or sweepstakes conducted by Ellensburg Radio Broadcasting, LLC dba KXLE AM/FM, including KXLE-AM and KXLE-FM, you agree to be bound by these General Contest and Sweepstakes Rules, along with any contest-specific rules that may apply.
NO PURCHASE NECESSARY
No purchase is necessary to enter or win any KXLE AM/FM contest or sweepstakes. A purchase will not increase your chances of winning.
HOW TO ENTER
KXLE AM/FM may conduct contests and sweepstakes through one or more entry methods, including but not limited to on-air, online, social media, telephone, email, in-person, or other methods announced by the Station.
For online contests or sweepstakes, listeners must enter as instructed at KXLERadio.com or through the specific online entry form provided for that contest.
For on-air contests or sweepstakes, listeners must enter as explained by KXLE AM/FM on-air talent or in on-air promotional announcements. This may include calling the number announced, submitting a code word, answering a question, or participating in another stated method of entry. For call-in contests, the person who completes the call will be considered the entrant. Prizes may not be transferred to another person.
For social media contests or sweepstakes, listeners must enter as instructed on the applicable KXLE AM/FM social media page or post. Social media contests are not sponsored, endorsed, administered by, or associated with Facebook, Meta, Instagram, X, or any other third-party social media platform unless specifically stated. By entering, you are providing your information to KXLE AM/FM and not to the social media platform.
Unless otherwise stated by KXLE AM/FM, there is a limit of one entry per person, per contest or sweepstakes. Any person submitting more than one entry, using multiple identities, or attempting to circumvent the rules may be disqualified.
WINNER SELECTION AND NOTIFICATION
Winners will be selected according to the method announced for each contest or sweepstakes. Unless otherwise stated, winners may be selected at random from all eligible entries received.
Winners may be notified by phone, email, text message, direct message, on-air announcement, or another method determined by KXLE AM/FM. KXLE AM/FM is not responsible if a winner cannot be contacted, does not respond, provides incorrect contact information, fails to check messages, or is otherwise unable to receive notification.
If a potential winner cannot be contacted, fails to respond within the time required, is found to be ineligible, or does not comply with these rules, the prize may be forfeited and an alternate winner may be selected at the sole discretion of KXLE AM/FM.
PRIZES
The number of winners, specific prizes, and approximate retail value of prizes will typically be announced on-air, posted online, or included in contest-specific materials.
Prizes are not transferable, exchangeable, or redeemable for cash. No substitution of a prize is permitted by the winner. KXLE AM/FM reserves the right to substitute a prize, or any portion of a prize, with another prize of equal or greater value at its sole discretion.
Prizes must be accepted as awarded. No portion of a prize may be sold, bartered, transferred, or listed for resale on any third-party marketplace, including but not limited to eBay, Craigslist, Facebook Marketplace, or similar platforms.
Odds of winning depend on the number of eligible entries received and/or the method of contest participation.
Winners are responsible for all federal, state, and local taxes associated with accepting a prize. KXLE AM/FM may require completion of tax forms, including IRS Form W-9, and may issue an IRS Form 1099 when required by law.
For event tickets, seat locations are at the sole discretion of KXLE AM/FM, the sponsor, promoter, venue, or prize provider. KXLE AM/FM is not responsible for event cancellations, postponements, rescheduling, venue changes, artist changes, weather-related changes, or any other issue related to an event prize. Winner will look solely to the promoter, sponsor, venue, or prize provider for fulfillment or resolution.
Winner will look solely to the manufacturer, service provider, sponsor, promoter, or prize provider for any warranty, defect, service, liability, or fulfillment claims related to a prize.
CLAIMING A PRIZE
Unless otherwise stated by KXLE AM/FM, prizes must be claimed in person at the KXLE AM/FM business office or at another location designated by the Station.
Prizes must be claimed during normal business hours within thirty (30) days of winning unless a shorter deadline is announced or required by the nature of the prize. Failure to claim a prize within the required time period may result in forfeiture.
Winners must provide valid identification acceptable to KXLE AM/FM before receiving a prize. Acceptable identification may include a valid driver’s license, state-issued identification card, passport, or other documentation deemed acceptable by the Station.
KXLE AM/FM may require a winner to complete and sign a liability release, publicity release, tax form, affidavit of eligibility, or other documentation before a prize is awarded. Failure or refusal to complete required documentation may result in forfeiture of the prize.
All unclaimed prizes remain the property of KXLE AM/FM.
ELIGIBILITY
Unless otherwise stated in contest-specific rules, KXLE AM/FM contests and sweepstakes are open to legal residents of Washington State who are eighteen (18) years of age or older at the time of entry.
Employees, officers, directors, representatives, and agents of Ellensburg Radio Broadcasting, LLC dba KXLE AM/FM, any contest sponsor, prize provider, promotional partner, advertising agency, or any local radio or television station in the Kittitas County area are not eligible to enter or win. Immediate family members and household members of those individuals are also not eligible.
For purposes of these rules, immediate family includes spouses, parents, children, siblings, grandparents, grandchildren, and in-laws, regardless of where they live. Household members include people who share the same residence, whether related or not.
Unless otherwise stated, a person or household may not win more than one prize from KXLE AM/FM within thirty (30) days. This restriction applies even if a prize is declined or forfeited. Prizes valued at $20 or less may be excluded from this restriction at the sole discretion of KXLE AM/FM.
KXLE AM/FM reserves the right to disqualify any person who has been prohibited from contacting or participating in Station promotions, who has violated Station rules, who has engaged in abusive or inappropriate conduct, or who KXLE AM/FM determines may negatively affect the fairness, integrity, or operation of a contest.
All contests and sweepstakes are void where prohibited or restricted by law.
DEADLINES
Contest and sweepstakes deadlines will typically be announced on-air, posted online, or included in contest-specific materials. KXLE AM/FM is not responsible for lost, late, incomplete, illegible, misdirected, undeliverable, delayed, or unsuccessful entries.
Entries received after the stated deadline will not be eligible.
TECHNICAL ISSUES AND BROADCAST DELAYS
KXLE AM/FM is not responsible for technical failures, website errors, telephone line issues, busy signals, dropped calls, carrier or network problems, software or hardware malfunctions, internet delays, email delivery failures, text message failures, atmospheric conditions, power outages, human error, or any other issue that may prevent a person from entering or participating in a contest.
Listeners should be aware that online streams, smart speakers, apps, and webcasts of KXLE AM/FM programming may be delayed. Such delays may affect a listener’s ability to participate in time-sensitive contests. KXLE AM/FM is not responsible for any delay associated with streaming, digital distribution, or third-party platforms.
KXLE AM/FM will not accept collect calls.
RELEASE AND CONSENT TO USE NAME, LIKENESS, VOICE, AND ENTRY
By participating in a contest or sweepstakes, each entrant agrees to release, indemnify, and hold harmless Ellensburg Radio Broadcasting, LLC dba KXLE AM/FM, its officers, directors, employees, agents, parent companies, subsidiaries, affiliates, sponsors, promotional partners, prize providers, and advertising agencies from and against any and all claims, damages, losses, expenses, injuries, liabilities, or actions arising directly or indirectly from participation in the contest or sweepstakes, or from the acceptance, possession, use, misuse, or inability to use any prize.
By entering, each entrant grants KXLE AM/FM the right to use the entrant’s name, voice, likeness, entry, photograph, video, city and state of residence, and/or recorded statements for promotional, advertising, publicity, and broadcast purposes without additional compensation, unless prohibited by law.
WINNER LIST
Upon request, KXLE AM/FM may provide the name of a contest or sweepstakes winner after the contest has concluded.
To request a winner list, send a written request identifying the specific contest or sweepstakes to KXLE AM/FM at the Station’s business address listed on KXLERadio.com. Requests must be received within thirty (30) days after the prize is awarded. KXLE AM/FM may require a self-addressed, stamped envelope for mailed responses.
GENERAL CONDITIONS
Decisions of KXLE AM/FM concerning any and all matters related to contests and sweepstakes are final.
KXLE AM/FM reserves the right to change, modify, suspend, cancel, or terminate any contest or sweepstakes at any time, with or without notice, if the Station determines that the integrity, fairness, security, or proper conduct of the contest has been affected.
KXLE AM/FM reserves the right to amend these General Contest and Sweepstakes Rules at any time. Contest-specific rules may supplement or modify these general rules. In the event of a conflict between these General Contest and Sweepstakes Rules and contest-specific rules, the contest-specific rules shall control.
KXLE AM/FM is not responsible for printing errors, typographical errors, incorrect announcements, website errors, prize description errors, or any other mistake in contest materials, promotional announcements, or rules.
If a contest or sweepstakes is judged, all judges’ decisions are final.
KXLE AM/FM reserves the right to make changes necessary to protect the integrity of the Station, the contest, the sponsor, the prize provider, and the listening audience.
KXLE AM/FM reserves the right to discontinue any contest or sweepstakes at any time.
IMPROPER CONDUCT
KXLE AM/FM may disqualify any entrant from participating in any contest or sweepstakes, refuse to award a prize, require the return of a prize, or void any portion of a prize if the entrant engages in conduct the Station determines to be improper, unfair, fraudulent, abusive, or harmful to the operation of the contest or to other entrants.
Improper conduct includes but is not limited to falsifying information, using multiple identities, violating these rules, tampering with the entry process, using automated scripts or programs, attempting to manipulate results, allowing another person to use the entrant’s information, harassing Station staff, abusing contest sponsors or prize providers, or otherwise interfering with the legitimate operation of a contest.
Any attempt to deliberately damage, disrupt, or undermine the legitimate operation of a contest or sweepstakes may violate criminal and civil laws. KXLE AM/FM reserves the right to seek damages or other remedies from any person responsible for such conduct to the fullest extent permitted by law.
If, for any reason, a contest or sweepstakes cannot be conducted as planned due to fraud, technical failures, unauthorized intervention, tampering, event cancellation, scheduling changes, weather, emergency conditions, or any other cause that KXLE AM/FM determines may affect the fairness, integrity, security, or proper conduct of the contest, KXLE AM/FM reserves the right to cancel, terminate, modify, or suspend the contest and select a winner from eligible entries received prior to the action taken, or in another manner the Station deems fair and appropriate.
SPONSORS AND PRIZE PROVIDERS
KXLE AM/FM may conduct contests and sweepstakes in partnership with sponsors, advertisers, promoters, venues, organizations, or prize providers. By participating, entrants agree that such sponsors and prize providers may also be released from liability to the same extent as KXLE AM/FM.
Winner will look solely to the sponsor, promoter, venue, client, manufacturer, or prize provider for prize fulfillment when applicable.
KXLE AM/FM is not responsible if a sponsor, promoter, venue, client, or prize provider fails to deliver, modifies, cancels, postpones, reschedules, or changes any part of a prize package.
AGREEMENT TO RULES
By entering any KXLE AM/FM contest or sweepstakes, each entrant agrees to be bound by these General Contest and Sweepstakes Rules, any contest-specific rules, and the decisions of Ellensburg Radio Broadcasting, LLC dba KXLE AM/FM, which are final in all respects.
